Florida Electronic Notice Law: Key Updates for Property Managers
On April 29, Governor Ron DeSantis signed HB 615—Electronic Delivery of Notices Between Landlords and Tenants—into law, marking a significant modernization of Florida’s Landlord-Tenant Act. Effective July 1, 2025, this new statute (Florida Statute 83.5051) will allow landlords and tenants to send and receive legal notices electronically, provided both parties consent and specific requirements are met.
What’s Changing?
Historically, Florida law required all legal notices between landlords and tenants to be delivered in writing, either by mail or hand-delivered to the resident’s unit. While property managers have long used email, text, and online portals for day-to-day communication, official legal notices were still bound by these outdated, often cumbersome methods.
With HB 615, the process is streamlined. Now, landlords and tenants can opt in to electronic delivery, making legal communications more secure, efficient, and private.
Why This Matters
Traditional notice delivery methods—mail, hand-delivery, or posting notices on doors—can be inefficient, raise privacy concerns, and even create safety risks or distress for residents. The new law brings Florida’s policies in line with modern communication practices, giving both landlords and tenants a convenient, technology-driven alternative that enhances privacy and reliability.
Important Update for Florida Click & Lease Users
The National Apartment Association (NAA) has announced that, starting June 25, 2025, an electronic notice addendum will be available in the Click & Lease portal. This makes it even easier for property managers using Click & Lease to comply with the new law and offer residents a seamless experience.
